Yahya related to me from Malik from Ibn Shihab that al-Qasim ibn Muhammad said that he had heard a man asking ibn Abbas about booty. Ibn Abbas said, "Horses are part of the booty and personal effects are as well."
Then the man repeated his question, and Ibn Abbas repeated his answer. Then the man said, "What are the spoils which He, the Blessed, the Exalted, mentioned in His Book?" He kept on asking until Ibn Abbas was on the verge of being annoyed, then Ibn Abbas said, "Do you know who this man is like? Ibn Sabigh, who was beaten by Umar ibn al-Khattab because he was notorious for asking foolish questions."
Yahya said that Malik was asked whether someone who killed one of the enemy could keep the man's effects without the permission of the Imam. He said, "No one can do that without the permission of the Imam. Only the Imam can make ijtihad. I have not heard that the Messenger of Allah, may Allah bless him and grant him peace, ever said, 'Whoever kills someone can have his effects,' on any other day than the day of Hunayn."

"Fatimah came to the Prophet (saw) to ask him for a servant, and he said: 'I do not have anything to give you.' So she went back, but after that he came to her and said: 'Is what you asked for dearer to you, or something better than that?' Ali said to her: 'Say: something better than that.' So she said it. He said: 'Say: Allahumma Rabbas-samawatis-Sab'i wa Rabbal-'Arshil-'Azim, Rabbana wa Rabba Kulli shay'in, munzil at-Tawrati wal-Injili wal-Quranil-'Azim. Antal-Awwalu fa laysa qablaka shay', wa Antal-Akiru fa laysa ba'daka shay', Antaz-Zahiru fa laysa fawqaka shay', wa Antal-Batinu fa laysa dunaka shay', Iqdi 'annad-daina wa aghnina minal-faqr (O Allah, Lord of the seven heavens and Lord of the Mighty Throne, Our Lord, and the Lord of Everything, Revealer of the Tawrah, the Injil and the Magnificent Quran. You are the First and there is nothing after You; You are the Last and there is nothing after You. You are the Most High, and there is nothing above You, and You are the Most Near and there is nothing nearer than You. Settle our debts and make us free of want).'"

a man from among the Ansar had a dispute with Zubair in the presence of the Messenger of Allah (saw) concerning the streams of the Harrah with which he irrigated his palm trees. The Ansari said: "Let the water flow," but he refused. So they referred their dispute to the Messenger of Allah (saw). The Messenger of Allah (saw) said: "Irrigate (your trees) O Zubair, then let the water flow to your neighbor." The Ansari became angry and said: "O Messenger of Allah (saw), is it because he is your cousin (son of your paternal aunt)?" The expression of the Messenger of Allah (saw) changed, then he said: "O Zubair, irrigate (your trees) then retain the water until it reaches the walls." Zubair said: "I think this Verse was revealed concerning that: "But no, by your Lord, they make you (O Muhammad) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission.'" Yahya related to me from Malik thal Yahya ibn Said heard al-Qasim ibn Muhammad and Sulayman ibn Yasar both mention that Yahya ibn Said ibn al-As divorced the daughter of Abd ar-Rahman ibn al-Hakam irrevocably, so Abd ar-Rahman ibn al-Hakam took her away A'isha umm al-muminin sent to Marwan ibn al-Hakam who was the Amir of al-Madina at that time. She said, "Fear Allah and make him return the woman to her house." Marwan said in what Sulayman related, ''Abd ar-Rahman has the upper hand over me." Marwan said in what al-Qasim related, "Hasn't the affair of Fatima bint Qays reached you?" A'isha said, "You are forced to mention the story of Fatima " Marwan said, "If you know that evil, whatever evil there was between those two is enough for you." (See hadith 67.)

"The Messenger of Allah (saw) stood up and addressed the people saying: 'No, by Allah, I do not fear for you, O people, but I fear the attractions of this world that Allah brings forth for you.' A man said to him: 'O Messenger of Allah(saw), does good bring forth evil?' The Messenger of Allah (saw) remained silent for a while, then he said: 'What did you say?' He said: 'I said, does good bring forth evil?' The Messenger of Allah (saw) said: 'Good does not bring forth anything but good, but is it really good? Everything that grows on the banks of a stream may either kill if overeaten or (at least) make the animals sick, except if an animal eats its fill of Khadir* and then faces the sun, and then defecates and urinates, chews the cud and then returns to graze again. Whoever takes wealth in a lawful manner, it will be blessed for him, but whoever takes it in an unlawful manner, his likeness is that of one who eats and it never satisfied.'"

On the Day of Nahr (10th of Dhul-Hijja, in the year prior to the last Hajj of the Prophet when Abu Bakr was the leader of the pilgrims in that Hajj) Abu Bakr sent me along with other announcers to Mina to make a public announcement: "No pagan is allowed to perform Hajj after this year and no naked person is allowed to perform the Tawaf around the Ka'ba. Then Allah's Apostle sent 'All to read out the Surat Bara'a (At-Tauba) to the people; so he made the announcement along with us on the day of Nahr in Mina: "No pagan is allowed to perform Hajj after this year and no naked person is allowed to perform the Tawaf around the Ka'ba."

that a
person with dishevelled hair, one of the people of Najd, came
to the Messenger of Allah (may peace be upon him). We heard
the humming of his voice but could not fully discern what he
had been saying, till he came nigh to the Messenger of Allah
(may peace be upon him). It was then (disclosed to us) that he
was asking questions pertaining to Islam. The Messenger of
Allah (may peace be upon him) said: Five prayers during the
day and the night. (Upon this he said: Am I obliged to say any
other (prayer) besides these? He (the Holy Prophet, ) said:
No, but whatever you observe voluntarily, out of your own free
will, and the fasts of Ramadan. The inquirer said: Am I
obliged to do anything else besides this? He (the Holy
Prophet) said: No, but whatever you do out of your own free
will. And the Messenger of Allah told him about the Zakat
(poor-rate). The inquirer said: Am I obliged to pay anything
else besides this? He (the Holy Prophet) said: No, but
whatever you pay voluntarily out of your own free will. The
man turned back and was saying: I would neither make any
addition to this, nor will decrease anything out of it. The
Prophet remarked: He is successful, if he is true to what he
affirms.

Malik related to me from Nafi from al-Qasim ibn Muhammad from Aisha, the wife of the Prophet, may Allah bless him and grant him peace, that she bought a cushion which had pictures on it. When the Messenger of Allah, may Allah bless him and grant him peace, saw it, he stopped at the door and did not enter. She recognised disapproval on his face and said, "Messenger of Allah, I turn in repentance to Allah and His Messenger. What have I done wrong?" The Messenger of Allah, may Allah bless him and grant him peace, said, "What is the meaning of this cushion?" She said, "I bought it for you to sit and recline on." The Messenger of Allah, may Allah bless him and grant him peace, said, "Those who make such pictures will be punished on the Day of Rising. It will be said to them, 'Bring to life what you have created'. Then he said, 'The angels do not enter a house in which there are pictures.' "

Yahya related to me from Malik from his paternal uncle Abu Suhayl ibn Malik that his father heard Talha ibn Ubaydullah say, "Once one of the people of Najd came to the Messenger of Allah, may Allah bless him and grant him peace. He had dishevelled hair and although his voice could be heard we could not make out what he was saying until he drew nearer and then we found he was asking about Islam. The Messenger of Allah, may Allah bless him and grant him peace, said to him, 'There are five prayers during the day and the night.' He said, 'Do I have to do anything else besides that?' The Messenger of Allah, may Allah bless him and grant him peace, added, 'And fasting the month of Ramadan.' He said, 'Is there anything else I have to do?' He said, 'No, except what you do of your own accord.' The Messenger of Allah, may Allah bless him and grant him peace, mentioned zakat. The man said, 'Is there anything else that I have to do?' He said, 'No, except what you do of your own accord.'
He continued, "The man went away saying, 'By Allah, I won't do any more than this, nor will I do any less.' The Messenger of Allah, may Allah bless him and grant him peace, said, 'That man will be successful, if he is telling the truth.'

That he asked for a salt flat called the salt flat of the Marib Dam to be given to him, and it was given to him. Then Aqra bin Habis At-Tamimi came to the Messenger of Allah (saw) and said: "O Messenger of Allah (saw), I used to come to the salt flat during the Ignorance period and it was in a land in which there was no water, and whoever came to it took from it. It was (plentiful) like flowing water." So the Messenger of Allah (saw) asked Abyad bin Hammal to give back his share of the salt flat. He said: "I give it to you on the basis that you make it charity given by me." The Messenger of Allah said: "It is a charity from you, and it is like flowing water, whoever comes to it may take from it."(One of the narrators) Faraj said: "That is how it is today, whoever comes to it takes from it." He said: "The Prophet (saw) gave him land and palm trees in Jurf Murad instead, when he took back the salt flat from him." Hasan
